Standard Schramm Limited Warranty

Unless indicated otherwise in writing, Schramm, Inc. (Schramm) warrants that new Schramm drilling rigs and supporting equipment will be free of defects in material and workmanship at time of shipment from factory origin. This warranty is subject to the following limitations:

  1. Warranty applies only to the original end user and is not transferable. It applies only to rigs and supporting equipment which have been subjected to normal use and preventative maintenance per original manufacturer recommendations.
  2. The period of warranty is 12 months from date of initial operation, not to exceed 18 months from date of shipment from factory origin or 2,000 operating hours, whichever occurs first.
  3. Spare parts warranty is limited to 6 months from date of shipment or 1,000 hours, whichever occurs first.
  4. Schramm’s obligation under this warranty will be solely to repair or replace defective components without charge, including standard freight of the components, labor and reasonable travel expense to servicing location. Duties and customs clearance charges as applicable are at the sole responsibility of the end user.
  5. For this warranty to apply the rig must be within the warranty period and available with reasonable access by Schramm authorized service personnel. In cases where reasonable access is not available, the end user will transport the rig to the nearest location in which reasonable access can be provided, with transportation at end user expense.
  6. Any component part installed to replace a defective component part during the initial warranty is warranted solely for the duration of the unexpired warranty on the rig or supporting equipment in which such a component is installed.
  7. Drilling rigs and supporting equipment may incorporate many component parts manufactured by companies other than Schramm; such as the truck chassis, carriers, tracks, diesel engines, compressors, automated pipe loading systems and other specialized equipment. Schramm’s warranty does not apply to such component parts or sub-systems. For equipment and components mentioned in this section, the end user will address warranty service and support direct with the original manufacturer or nearest authorized servicing distribu
  8. This warranty does not apply to standard consumables and preventative maintenance items, including, but not limited to rotation swivel packing, wear sleeves, V-belts, filters, batteries and lubricants.
  9. This warranty does not apply to normal maintenance and service and adjustments, including, but not limited to engine valve adjustments, fuel, air and hydraulic system cleaning, engine tune-up, clutch inspection and adjustment.
  10. Schramm reserves the right to request the return of failed components to Schramm USA factory origin for evaluation at Schramm expense.
  11. Schramm will not be liable for defects, damages or failures caused by unauthorized alternations, use of non-approved parts, unreasonable use, neglect, abuse, accident, negligent repair or failure to perform proper maintenance
  12. It is the responsibility of the end user to report warranty claims in a timely manner. Damages resulting from failure to report such claims promptly are not covered under this warranty.
  13. Schramm reserves the right to make design changes or any product improvements at any time, without incurring any obligation to install same on units previously manufactured.
  14. There are not warranties, expressed or implied, other than the limited warranty as set forth above. This limited warranty supersedes any warranty, promises or representations previously made or issued. THERE ARE ABSOLUTELY NO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE and Schramm hereby excludes all such warranties which might otherwise be implied by law.
  15. Schramm’s liability for breach of this limited warranty, whether a claim or lawsuit is brought in contract, tort, or strict liability, will be limited exclusively to repair or replacement of defective parts covered by the terms of this limited warranty. Schramm will not be liable for any direct or indirect incidental or consequential damages of any kind which may result from defects in its products, service, or from breach of this limited warranty, nor will Schramm be liable for any damages resulting from the end user’s loss of use of the drilling rig and/or its supporting equipment.
